Anti-Dumping and Countervailling Proceedings


Anti-dumping & Countervailing Investigations

The Canada Border Services Agency (CBSA) and the Canadian International Trade Tribunal (CITT) are jointly responsible of the investigative process. The whole process takes about seven months from the time the CBSA initiates an investigation to the time the CITT issues its finding.

While the CBSA is responsible of determining whether dumping or subsidizing has occured, the CITT is responsible of determining whether such dumping or subsidizing has caused injury to the Canadian industry. In order to impose anti-dumping and/or countervailling duties, dumping/subsidizing must have occured and the dumping/subsidizing must have injured the Canadian industry.


Normal Value Reviews

Normal value reviews are conducted by the Canada Border Services Agency to update normal values, export prices or amounts of subsidy, as necessary, to ensure that these values accurately reflect current market conditions.

Procedures followed during a normal value review are similar to those of a re-investigation with the exception that each review is conducted with respect to a single exporter only.


Expiry Reviews

As for the investigation processes, Expiry reviews are conducted jointly by the CBSA and the CITT. While they are conducted seperately and have different timeline, their purpose is to review orders and findings to determine whether measures in force should will be rescinded or continued for another five years.
